Terms of Service
Last updated: October 21, 2026
These terms are the rules for using MPS Scheduling. By using the service you agree to them. We have tried to keep them short and plain.
Who we are
MPS Scheduling is a staff scheduling web app, operated by Vincent Rubio, doing business as MPS [PLACEHOLDER: replace with the LLC's legal name and mailing address once formed]. In these terms, “we” means the operator. Please also read our Privacy Policy, which explains how we handle information.
Who can use it, and accounts
You can use MPS Scheduling if your organization has set up an account for you, or if you are setting up an account for your organization. Keep your password private, give accurate information, and tell us if you think someone else has used your account.
Organizations and admins
Each organization has an admin. The admin is responsible for the organization's users and information: who is given access, who is made a manager, whether the information entered is accurate, and having the right to enter people's information into the service. Admins should tell their staff how their information is used.
Your information stays yours
You and your organization keep ownership of the information you put into MPS Scheduling. You allow us to store it, process it and show it to the right people so we can run the service (including sending the emails the service sends). You can ask for a copy or for deletion at any time.
Acceptable use
Please do not:
- break the law or someone else's rights;
- try to see or change information you are not allowed to see or change, or try to get around the service's security;
- disrupt or overload the service, or upload anything harmful;
- pretend to be someone else;
- use the service to harass or discriminate against people.
Free pilot, provided “as is”
MPS Scheduling is currently a pilot (beta). It is provided “as is” and “as available.” We do not guarantee that it will always be available, free of mistakes, or that nothing will be lost. Features may change or be removed. Keep your own copy of anything you cannot afford to lose.
Hour limits and labor rules are only aids
MPS Scheduling shows warnings about weekly hour limits, breaks and similar rules to help managers plan. These warnings are a helpful aid. They are not legal, HR or payroll advice, and they can be wrong, out of date, or may not apply to your situation. Managers and organizations remain responsible for following the law and their own policies, and for checking hours themselves.
Cost
MPS Scheduling is free during the pilot. If we decide to charge, we will tell you at least 30 days in advance, and you can stop using the service instead of paying.
Suspending accounts, and stopping
We can suspend or close an account that is abusive, breaks these terms, or puts the service or other people at risk. We will try to tell you first when that is practical. You can stop using MPS Scheduling at any time, and you can ask us to delete your information (see the Privacy Policy).
Limits on our responsibility
To the extent the law allows, we are not responsible for indirect or consequential losses, such as lost profits, lost data, scheduling mistakes, or claims from employees or others about pay, hours or working conditions. If we are ever responsible to you, our total responsibility is limited to the amount you paid us in the 12 months before the problem, which is $0 while the service is free. Some places do not allow these limits, so they may not apply to you.
Changes to these terms
We may change these terms. We will update the “Last updated” date, and for important changes we will tell organization admins by email or in the app before they take effect. If you keep using the service after a change, you accept the new terms.
Governing law
These terms are governed by the laws of the State of New Jersey.
